The criminal records of the participants didn't factor into the shoot or not decision, but the jury is being asked to judge the situation as a whole. The motivation and state of mind of the first attacker especially, seems relevant to me.
Like the judge prevented the use of "victim" but allowed "arsonist" or other terms when the defense could show evidence for it. When the prosecutor brought a relative for a character witness it opened up some room for the defense to bring up evidence to the contrary.
