He seeded the wheat than found out the elavtor messed up and gave him a different variety than he wanted. They fessed up to it. He even received the certification papers for it but turns out it was a completely different variety. How liable is the elevator for this. If the variety he seeded yields less than the variety he wanted what steps can he take to get compensation from the elavator? What would you do in this situation? Fraud or mistake, somebody is liable. Somebody needs to take care of business.
tommy1993 - 8/19/2009 11:42 The wheat was brought in by truck load so no tags or bags were envolved. This is the very reason state seed certifying agencies have resisted certifying "bulk" seed containers and packaging! When one little step is missed, there are problems! I am sure that most state certification agencies, if they do allow such practices, have regulations in place that certain certification documentation must accompany to seed when stored, loaded, and delivered. Again, somebody needs to take care of business better. Just like the saying says, "Buyer Beware!"
