Not sure if this pertains to you, but their insured person may be at the top of their policy limit, and it would take a miracle to get the insurance company to pay more than policy maximum. In Indiana the state minimum is $25k for property damage. I've dealt with this in the past. I do believe you have up to 2 years to settle.
