SW KS | Because of yesterday's discussion I spent the better part of this afternoon with various Troopers and DMV personnel. Thankfully they all had the same answer so that would lead me to believe they were all correct. The rules according to them are as follows.............
Once you are hauling more than 502 gallons of Hazardous Material a HAZMAT endorsement is needed, which also means a CDL is needed. Once a CDL is "required" you only need to be hauling 119 gallon of liquid to need a TANKER endorsement. Also once the 502 gallons of Hazardous Material criteria is met, all farmer exemptions are void on that vehicle. So like they pointed out, the million dollar question is "What is a Hazardous Material?" According to them all "Restricted Use Pesticides" are Hazardous Materials, but were unable to tell me if Roundup, Banvel, Crop Oil and the like were.
So in my case if I had 3000 H2O and 503 gallons of Atrazine I would need a CDL, Tanker, HAZMAT and physical card. However if I had 3000 H2O and 501 gallons Atrazine I only need a Class A liscense. Also If I had 3000 H2O and 750 gallon of Touchdown, it depends on if Touchdown is considered a Hazardous Material whether or not I need just a Class A or the whole load of crap.
So, after all the questions I gave them, I still do not know what is, and what is not a Hazardous Material. If they are the ones enforcing the laws you would think they should know in order to issue a ticket. Maybe I should just put all my chemical in non restricted use shuttles and go for it.
