Best thing would be to talk to an attorney local that can advise you of any laws there in your area.

From sitting in the chair reading what you wrote, it seems to me he's s.o.l.

after 7 years now, it's established. He tears it out or plugs it and I think he'd be in a real pickle.

To hell with the nice hat........go up and tell him he touches that tile your calling the law. anything happens across the road and he's going to get blamed. He sticks you with a bill, file it in the trash bin. He sues you then worry about it.

Right now I'd be over there taking pictures so you can have a history photo on file of what it looked like so if he does do something you can prove how it was beforehand. Also, make sure you got something to prove the date. Video is wonderful and video the date and time on your cell phone while video'n the arrangement.

I've always been fond of the speak softly and carry a big stick option but I realize we are sposed to be in more civil times now.
