Guy I know, 59 getting divorced. 

He has amassed approximately 700 tillable acres of owned land, and rents the rest.

The wife wants 50% of the assets, including the land and machinery or wants bought out for 50% of the value of the land at today's market price.

Obviously that cash doesn't exist in a savings account, she did nothing for the business during the marriage. 

 

 

What can he do to keep his farm?

 



He can choose which farm he wants to call “his farm” and keep that one and give her other ones, or go get a really big loan and pay her off.

The judge won’t care what your friend says about what the wife did or didn’t do for the farm during the marriage.

That said what ever caused the divorce no one will really know except the 2 involved and sometimes as much as I hate to say it the wife may deserve 1/2 or more if there has been any physical or mental abuse. All in all the guy needs to get a good lawyer and figure it out on his own and figure out if he even wants to keep farming... Sucks to be at any age and go through a divorce but to be pushing 60 and going through it has to really suck.. A fella in our area went through this about 15 years ago owning 1200=1500 acres. I think he came out very well but for what he put his wife through according to public opinion she should have cleaned him... Sad deal all the way around... :(
