I hate to burst your bubble but they absolutely can file suit on the account unless precluded by the statute of limitations.  Whether you are paying $100 or $1,000 per month is of no legal consequence.  It is fair to say they usually are disinclined to file suit if you are paying but may do so if they so choose.
