Getting to be fewer and fewer fencelines around here. Can't recall anybody going into the FSA or NRCS and asking. Most just take them down. Never heard of anyone getting in trouble either. Makes it so much nicer for spraying, combining, ect.. by not having trees hanging over or weeds growing in the fenceline.
