I'm sure my time is being wasted as I type a response!

If the will goes through probate the judge may render a new deed without restrictions.  Depending on the wording in the will, it possibly won't be binding on the new owner.

Different states.........different laws.

My guess is the will won't have any binding effect on the new owner unless it provided for an easement to be filed before the sale/transfer of the deed which directs the allowed use of the land.
