Depends on your fence laws. In Iowa, we have a "face your neighbor and fence to the right" understanding. That means I have the responsibility to building and maintaining the right half of every boundary fence unless there is some other agreement in place between neighbors. If cattle are continually getting through the half of the fence that you are supposed to be maintaining, he may have a case that he is not responsible for damages. That being said, if they were my cattle, I would make sure that I would keep good neighbors happy by making sure there that any wrong was made right. Many times, if cattle are always looking for a way out, it is indicative of poor management in terms of fencing, nutrition, attention to detail, etc. Content cattle aren't often pushing fences.
