croptecsolutions - 5/23/2016 22:22 OK my father was killed in an automobile accident almost 2 years ago. The trustee of the estate has been HORRIBLE to work with to the point of my sister and I having to hire an attorney to talk to her. Anyway my nephew (sisters son) was in the vehicle with my dad when the wreck occurred and between the helicopter ride and the medical bills she is out around 120k. We have asked the trustee to file a lawsuit against the other drivers insurance company and the uninsured motorists coverage of my dad's to pay these medical bills but the trustee refuses to file a lawsuit. From everything my sister and I can find online she is to do what our wishes are since we are the only benificiaries. Does anyone have any advice as to what we can or can't do. Ps... We are not wanting to pocket millions just get the medical bills paid. 

Sounds like two different problems here . . . .

As someone asked, is this a trust or an estate ? Either way, get a competent attorney (that has experience with estates/trusts and seek experienced ones), and dismiss this "trustee".

Then seek a competent attorney and file suit for the insurance to settle the medical bills - sounds like a insurance company not performing and with your limited info, guessing someone needs to "motivate" the insurance companys?
