I'm a bit confused. The estate should have an executor, not a trustee. Is there a trust involved somehow?

I don't think the executor is under your control although I would think that the executor has a duty to do whatever is required to collect any monies due to the estate (even if it will be paid to your sister) to make it whole after the accident. But you really haven't given enough detail to make a recommendation (nor should you on a public forum). About the only advice I can give is to consult an attorney and have him or her find out what is going on as the estate attorney has no duty to represent you or your sister. The estate attorney represents the estate and executor. And they have legal rules they are bound to follow. Although I've seen some pretty strange things happen in these deals. It's up to you to make sure what's in the will and that it's followed.
