| I read an article yesterday that said that agriculture is not exempted and the onerous was on the employer to prove that the employee was not due overtime pay.
The article emphasized that the employer had to pay overtime unless the employer could prove that the employee was not due overtime.
The article was not about agriculture employers but did add the comment that agriculture was not exempt.
The remedy from this article was to raise the pay above the maximum amount or turn the employee into an hourly worker or leave the employee salaried and pay overtime. Since this is a new change there will have to be a few lawsuits to settle this overtime issue.
Agriculture is losing its ability to not abide by laws and regulations that everyone else has to follow.
