General contractor is responsible for making sure things are correct before work progresses. This fix is on the general and the plumber and you should only have to deal with the general, that's what he gets paid for. That said, tearing up the floor will not hurt the footings but I would at least expose the perimeter drain to make sure it isn't smashed of full of holes from a jackhammer. Is there no way the walls can be moved to accommodate the misplaced plumbing? That's where I would start. I can't say I'd like to see mechanical splices embedded in concrete either.
