Like them or not, but any lawyer will completely disagree with this and show it holds no merit.

1. There wasn't a contract stating you are responsible for lug nut torque prior to work. This is important because...
2. People own vehicles without mechanical knowledge.
3. It is a fair expectation of a professional tire shop to properly torque wheels.
4. The wheel fell off due to tire shop negligence, not because of unusual conditions after the shop work. By claiming the driver should have retorqued the bolts in case the tire shop made an error, that doesn't shift negligence to the driver.
5. End of discussion.
