How is that an example of overreaching communism at its worst? Perhaps you could start at the basics for me, I'm a bit dense. Like the definition of communism vs a democratic republic and how a law against the operators of commercial motor vehicles using a phone without a headset is an example of one of those two forms of government and why it would not happen in the other form?

My understanding of justice leads me to believe that you are free to do whatever you want as long as it does not interfere with the freedom of another. An example would be how you're free to talk on your cell phone without a headset as long as it does not increase the probability that you take away the freedom of another person to continue living.

If statistics prove that someone talking on their phone without using a hands free device makes them more likely to kill other people on the road, people who choose to talk on their phone without a hands free device while driving should be punished.

I have had some really scary things happen to me while I was driving distracted (although it was not talking on the phone). I'm quite fortunate that:

1. I wasn't in a semi when it happened because people would have likely died had I been in one.
2. I didn't kill anyone else
3. I didn't kill myself
4. I didn't damage any property other than my own
5. There were no police officers present
6. The other person involved either didn't notice or didn't care and left instead of involving him/herself and likely causing me to be in legal trouble
7. I had the means to pay for the damage to the stuff I destroyed (all my stuff)

Distracted driving is a serious offense and those who are in commercial vehicles are supposed to be professional while they're behind the wheel. It's just part of the job.
