Hard to respond without getting political, but a lot of people after hearing both sides on this argument would side with the EPA.

The clean water act was clearly meant for navigable streams, the reason for that was at the time of writing the govt didn't have jurisdiction unless it was interstate commerce. Somewhere along the line the supreme court decided it applied to all water going into navigable streams and now the epa is trying to get control of all water.


I have heard more and dont think you are correct but who knows.
