Actually it was OSHA that took away the exemption from Ag Retailers in regards to Process Safety Management. OSHA's concern lies with employee safety and not environmental issues. Congress found fault with OSHA's ruling but OSHA is thumbing their nose at them and going forward with enforcement this fall. Primarily more paperwork and red tape for the Retailers as it does affect how EPA will require Risk Management Plan reporting.
