I'm not a lawyer but if a business fails with a great deal of debt outstanding and it can be shown that the principals looted the company I'm guessing that's considered fraud. Will they get away with it? I do know that when a local farmer tried very hard to avoid paying a $1 million dollar debt to a bank here and still keep his farm, the bank took it upon themselves to make sure he didn't prevail. Even though it eventually cost them a good deal of money (many thousands) it became a grudge thing and in the end they were willing to see to it that he didn't.
