"The law is that an SMV emblem must be on all implements of husbandry, but the definition of that has changed," he said. "It no longer depends on the action of the equipment but on the definition of an implement of husbandry."
The new definition includes tractors, self-propelled implements such as high-boy sprayers even if they travel much faster than 25 MPH, or "any vehicle adapted for carrying … equipment," Anderson said.
"There is no question now that self-propelled application equipment is not an implement of husbandry," he said. "And before the state law change, a gravity box was likely not an implement. Now it is."
Implement of Husbandry: Means a vehicle or trailer in use for the exclusive function of serving agricultural, horticultural, or livestock operations.
Implement of husbandry includes:
farm tractor
self-propelled application-type vehicle
farm wagon
farm trailer
a vehicle or trailer adapted for lifting or carrying another implement of husbandry, or
any substantially similar equipment used to transport products necessary for agricultural production
An implement of husbandry, meeting the above definition when operated on Michigan roads, requires an SMV.
