USA | There is a test that can tell if a bean is RR 1 or RR2, but so far haven't found a test that can tell the diff in a bean variety. Like they can wheat or corn, when it comes to enforcing a variety patent.
So if a soybean variety can't be tested to tell what it is, how can a company say without a doubt a bean growing in a field is theirs that has a patent on it?
Another question is how something can be allowed to be patented without proof it is what the seed company says it is ?
The burden of proof is on the patent holder to prove that patent infringement has taken place.
