My understanding, and remember I'm in Canada, is that an individual in the US is well within his rights to purchase and use a UAV to scout his own fields. It is however not legal for the same person to fly a neighbours field and then turn around and charge for the service. So perfectly legal for an individual, but not legal for commercial use.
