I'll be the first to admit I've been in a hurry and cut corners numerous times and just got lucky, now that I'm married with two little kids I go the extra mile to be as safe as I can be. You know the current situation better than any of us. So follow your gut. The safest employee you got could easily pull out in front of someone in a company vehicle tomorrow and cause a major lawsuit too, so I don't know if I would necessarily fire him from the lawsuit standpoint. I know it's different when you knowingly get into a bin vs. having an accident in a vehicle, but you get my drift. A lawsuit is a lawsuit. Would you handle this different if it were a son or a nephew.... would they be placed on leave for awhile or even fired?? Maybe ask him what he would do if he were in your shoes, would he fire his employee or how would he handle it?? Best of luck and I hope it all works itself out.
