south central MN | My personal opinion is if this is not the first time and you have admitted that here and you know it in your own mind I would have to let him go. In the eyes of lawyers and insurance companies you could be found to be gross negligence if this employe were to cause harm to himself or others in the future if he has a history of this and you know it. Gross negligence is when you let someone continue to do things when you are aware of their past negligence. It is hard to let an employe go because of the stress it causes us and it is a long process to find and train the right replacement but there are very serious consciences to let dangerous people to continue to work for you. | |
