No one should be terminated from a job for doing or not doing something they were never trained to do or not do the correct way. Second or third offense after being trained on proper procedure would be different. Example; if person is never told not to go into bin without safety procedures in place and they do it the way they have always done it and get in trouble you cannot fire them even though you know they have worked around grain bins all their life. What you haven't done in this situation is trained them on your safe procedures for entering a bin. Never expect an employee to do things the way you want them done safely unless you have trained them.
