Subject: RE: land survey question

Southeast Wyoming

Ben (MI) - 11/28/2012 07:57 I just purchased a 6.5 acre parcel on which I plan to build a new home and machine shed. No one claimed to have a had a copy of the land division survey. I even contacted the owner previous to the guy I bought it from with no luck. When I contacted our county surveyor I was told that they have the orginal survey but I will not have access to it. But, for $450 they will mark the corners for me. I have been able to find 3 of the 4 corner survey rods with plastic caps. My goal was just to have the survey on file if needed in the future and to be sure I mark my corners properly. Has anyone else experienced a surveyor making what appears to me to be a money grab like this? They told me they were just protecting themselves, is this what our lawyers have brought us to? Thanks for listening!!!

I'd be real surprised if you cannot obtain a certified copy of the original survey if it is in fact on file with your county government.  I suspect someone is stonewalling you.  And as others have said, having them mark the corners for $450 is relatively cheap.

Keep at them for that document, it should be public domain if on file at a government office, or at least available to the title holder of the property.  If you have a contract-for-deed, and are not the owner-of-record, then it may not be available to you until that contract is fulfilled.
