What??? First you say that iOS and Windows are "no doubt...closed". Then you say that the difference between open and closed is "nothing more than a legal issue"? I think you must be just arguing to argue now. There is SO much more to it than just a legal issue. Yes, Android is released under a "legal" license agreement that allows for generous modification and distribution under various terms and conditions. Yes, iOS and Windows are released under "legal" license agreements that say you CAN'T do those things (or can under MUCH more limited circumstances). No doubt there are legal differences between the two.
BUT, the foundation of Android is in the open-source software philosophy. The foundation of iOS is in the proprietary or closed-source software philosophy. That difference is fundamental and much deeper than any surface-level "legal" distinction.
