The law will basically apply one commonsense test in assessing liability. Did the person involved in the accident act with reasonable care, or was he/she careless in a way that contributed to the accident. What constitutes reasonable care will vary with the particular circumstances of the case. For example, you are held to a higher standard with regard to those who you invite onto your property as compared to a trespasser.
