In my opinion price later contracts ought to be illegal. There is nothing said that a new company has to honor the old contracts. In fact secured creditors may demand those unsecured assets be included to further secure their position. The bankruptsy court may well liquidate assets such as grain and sell the physical plant to a new investor. I would guess that there is little chance that a price later contract holder would be made whole.
