| I was referring to a crop production disaster which is not an intentional act to defraud the buyer. Yes one would have to arrange to fill the contract or arrange a settlement. However, the renegging is a willful act to cheat or defraud the grain buyer. Intent is the operative word. Even if one had an unsigned contract, the oral agreement was still made even if there is no apparent record of it.
Yes, I have had that very experience. A local elevator misplaced my signed soybean contract and asked me to sign another. I did sign another copy with the provision that it was a duplicate copy and I was only responsible to deliver the agreed amount. I'm not pretending to be mr good shoes, but I expect to honor my contracts and expect others to do the same. I want every nickle I am entitled to and nothing more. If a cashier gives me $5 too much change I will point out her error. But if she short changes me $5 I will point that out as well. I don't expect that to get me into heaven but hopefully I have earned the respect of people I deal with. | |
