West Tennessee | Have no idea about Illinois law but in TN a wife (over 10 years I think) is legally entitled to 40% of the estate. This may not apply in this case because of lots of factors but just thought I'd throw this out there. I've seen wives left land and other assets in trust and upon death of the husband, they contest the will and claim their 40% outside the trust. Maybe this doesn't apply in Illinois but thought I'd mention it so you'd be aware. There's also a thing called Generation Skipping Taxes you might should know something about too. FWIW. | |
