 SESD | On a 1/4 I purchased this year, I have a neighbor on 1 side that has 80ac pasture along the whole 1/2 mile. I do know the guy, but haven't talked with him yet about the situation. I have talked to the previous renters and other farmer beside him. They say he won't do anything about his cattle. The 1 guy even quit renting the other 80 of that 1/4 because of all the trouble. They don't know why this guy even has cattle, except to run his trucking company through the farm for taxes. He hasn't sold a calf in a number of years. He doesn't wean the calves or cut the bull calves. The guy said the some or most of the heifers die because they get bred too young and die calving. He also watched about 8 bulls/bull calves chase a cow into a water hole and drown her trying to get her bred. My friend(who drives by regularly) said the only feed the cows had one time was the straw they crapped and pissed all over and they ate every straw. They said he won't keep up the fences or get his cattle in when they do get out. He doesn't have insurance so they don't get paid any damages.
So what would you do. A few of the calves have been getting out and ate a couple rows of corn for a few hundred yards and I need to get something figured out. If they are getting out on my half of the fence, is it my duty to fix/update/upgrade if it is a descent 4 barb fence already? What about his half of the fence? Anybody know the fence laws in douglas county, sd. What steps do I need to take if he doesn't care? I figured I'd get you guys' input before I call him.
