The insurance goes with the vehicle, not the driver. You carry uninsured motorist insurance for this very reason.
If a friend borrows the vehicle this is where it applies. Same applies in this case.
A good lawyer would solve your problem in a hurry.
The way I read the original post, they're not denying this specific claim itself, they're saying that his entire policy is null and void because he did not accurately complete the policy application. So I think the age of the driver is irrelevant, and the insurer could deny any claim against that policy for the same reason. Whether a contract attorney could successfully counter that foundational argument is a good question. |
