I ask because the stalemate you describe is not the intention of Kansas state law. If fence 'judges' wouldn't do the job or one owner wish to ignore his/her obligation to permeter fencing, the law as I learned back in 2000 was written to allow a fix so that each owner shared to cost of a fencing 50/50.
