Might not be the case there but the cost of that fence can get added to his taxes if he’s wants to be a dink about it here.
OP I’d force the issue, out of area ownership is annoying in itself. He wants to extract dollars out of of your community but doesn’t want to maintain what it takes to do that in a proper fashion.
