Is a Will not a "Transfer upon death deed" ? Probate is not an evil in any way, unless you want to hide something personal?
The only evil part of Probate is handing an attorney 7 grand to probate a simple Will where all the heirs are in agreement on division of assets and to do the transfers on two land parcels. This could have been avoided if we’d been able convince Mother to do “Transfer on death deeds” instead of her thinking all she needed was a Will.
Your Attorney screwed you. You need to find a new Attorney. If all the heirs were in agreement, should have been a couple hours labor and a filing fee.
I agree, and yes that is precisely what I am in the process of doing. It also brings to mind the saying that it’s lawyers like this that give the other 1% a bad name. I’m including the chart for allowable charges for probating a will in Missouri, attorneys in Kansas are allowed to charge up to 5% of the value of the estate, the only thing guiding them is their conscience.
