If it is proven true, it is not defamation. It also sounds like your department has disciplined you or at least spoke to you, so there must be some truth in the alleged defamatory statements.
Whoever you sue is entitled to discovery. There really isn’t anything that is out of bounds during a discovery deposition in a civil suit.
I imagine the defendant in this matter will have their lawyer take full advantage, at least for entertainment value and ask all sorts of personal questions. I also expect they will counter sue to recover costs, so you may pay for two lawyers.
I’m also certain your lawyer would not be too pleased with you publicly discussing this case particularly informing the person you intend to sue of your intentions. | |
