Frisco, TX | Similar experience awhile ago, but I'd do this. If the shop is locked up and you know or have reason to believe the owner took bankruptcy, I'd first call the US Clerk of the Bankruptcy Court for your area. They will have a case number if bankruptcy case was filed. They can give or help you find the name of the debtor's counsel. You or your attorney can contact them to ask for a pickup of your property. Also the Trustee assigned to the case will also be interested in returning property to rightful owners to avoid litigation. Expect to provide proof of ownership. If the debtor/owner is honorable, the Trustee or the debtor's attorney may proactively contact you before you are able to make contact to arrange pickup, but don't expect it. If a repair job was part done, I'd take good pictures while on site to document what work was done. If you already paid directly for parts that are onsite and can be readily identified for your project you may be entitled to those too. Labor completed may be the sticky part. Court may rule you owe as an account receivable. If it's a significant amount, I'd get my lawyer involved to be safe. This is my experience only, this is not legal advice. | |
