Southern Missouri | Been through this a little and completely agree with reformed banker , if there’s never been an easement and they force one placed to eliminate a land lock situation and it is forced to your place and no body has ever paid for an easement to be there you’ll be entitled to a payment but they’ll be entitled to an easement. As reformed says if there’s other access points but nobody wants to take a payment and give one , a judge will say who gives it and how much they receive. Had two close neighbors battled this out and guy that didn’t want to grant easement and take payment finally did both , give the easement and take the payment, on advice from his legal counsel, the neighbor needing it had farmed ground back behind for years but was never an easement for the road he used , 2nd neighbor tried to close it off but eventually gave up and took the payment and gave easement, they both went back to being neighbors after that , was a little hairy for a while . Life’s a test everyday , my advice, keep your head down , do the right thing, you’ll pass the test . | |
