Last week, the U.S. House of Representatives passed a 2026 appropriations package that did not include language allowing for permanent, year-round E15 nationwide. Instead, lawmakers established a new E15 Rural Domestic Energy Council and tasked it with developing legislative solutions to “address the crisis facing our nation’s farmers and refiners.”

The move was a disappointment to the Minnesota Corn Growers Association (MCGA), which for months had advocated for the inclusion of an E15 legislative solution as part of the appropriations package. As MCGA has noted for years, ensuring permanent year-round E15 is one of the most meaningful steps Congress could take to bolster family corn farms and rural economies. Such action would be especially significant now, as corn farmers face the most dire economic conditions they’ve seen this century.

Still, MCGA remains committed to securing an E15 legislative fix in the coming months. Notably, we are optimistic that last week’s package requires a new council to submit legislative recommendations to Congress by Feb. 15 and for Congress to consider E15 legislation by Feb. 25. While not an excuse for inaction, those immediate deadlines set the stage for meaningful movement on E15 language.

Unfortunately, an outdated federal law currently bans the sale of E15 in most of the U.S. during the summer months. (The fuel can be sold during the summer in Minnesota and six other midwestern states.) The summertime restriction has nothing to do with the safety or quality of E15 as a fuel; it’s simply a relic of Clean Air Act provisions that were enacted in 1990, which was over two decades before E15 was even available to consumers.



MN and 7 other States (IL, IA, MO, NE, OH, SD, and WI) have year round E15...if incompetent Walz and MN lawmakers somehow managed to accomplish securing year round E15 for MN...other State lawmakers and Governors aren't trying very hard.

Federal Government Grants Request from Governor Walz for Year-Round Sale of E15

[ST. PAUL, MN] – Governor Tim Walz today applauded the federal government’s approval of his request to allow year-round sales of E15, beginning in 2025. This decision applies to eight Midwestern states, including Minnesota. The Governor will continue to push for an E15 waiver for 2024 and urges Congress to take action and pass legislation that would fix the issue nationally.

“Providing year-round sales of E15 is the permanent solution that was needed to provide long-term economic relief and certainty in the fuel market. This action means lower emissions and lower-cost choices for drivers,” said Governor Walz. “I’m grateful for the Biden Administration’s shared commitment to increasing consumer access to our nation’s homegrown biofuels – and we will continue to urge the White House to grant a waiver for 2024.”

In April 2022, Governor Walz wrote to EPA Administrator Reagan, requesting a permanent solution allowing the year-round sale of E15.

WASHINGTON – U.S. Environmental Protection Agency (EPA) Administrator Lee Zeldin has announced the agency’s decision to uphold the current April 28, 2025, implementation date to provide parity for E15 and E10 in Midwestern states. This action, requested by the governors of Illinois, Iowa, Minnesota, Missouri, Nebraska, Ohio, South Dakota, and Wisconsin, provides regulatory certainty for fuel suppliers and expands consumer access to E15 year-round in these states.
