I had forgotten about it. Did he ever get his plane back?
I have been following this, as of two weeks ago, no he did not get it back.
FAA has gotten involved, but we won't know anything for awhile. The Indian's probably left it outside and it will get damaged in the inclement weather. It was a fabric covered airplane of about 1949 vintage. Ice on the wings and some adverse conditions can ruin that. The engine already had a problem, that's why he landed.
A few laws tell me he'll get the plane back in the end.
1. The FAA controls all the airspace. Not any tribe.
2 He landed on a federal highway that happens to be in a reservation. Tribes don't control federal highways.
3. FAA regulations specifically PERMIT any action normally considered improper or unapproved if taken during an inflight emergency to benefit the safety of that flight. Such as landing on any road or field, among other things.
If that were me, I would sue the reservation for the full value of the aircraft, plus all court costs. I get the reservation is trying to flex its muscle and show who's boss. I think no well informed local will want to go there after this. It's a sad deal.
