But The Clean Air Act is law and in it the EPA is given the authority to do what they are doing, so while each tier of emissions might not be voted on by congress it is still federal law.
But if SCOTUS rules that Congress has no right to delegate it's legislative powers to a 3 letter agency said agency's laws made up rules become moot.
