If he wants to move at night, he better be able to get out of that oncoming lane, or have a pilot car to stop/slow down traffic. The car driver OBVIOUSLY should have taken more care, but now the combine driver will be left with all the fallout.
You're making the assumption that the combine was across the center line when contact was made. That isn't a given from the pictures alone.
