| Don't really know how hard they'd throw the book at individuals that aren't doing any harm, the few people I know that have been inspected by the FAA said they were very nice and easy to work with. But I think the max fine one could face is up to $75,000 plus some jail time for not being in compliance with the FAA. One example is the drone pilot that hit the super scooper in California had 14 days in prison and ordered to pay $156,000 for repairs.

FCC non compliance has its own penalties, and for individuals it's fairly lax but still could be $500 per offense or $500 per day per offence for repeated issues. Up to a year of jail under more extreme cases. They'd be more strict on distributors and dealers that are knowingly and continuing to sell non compliant devices. But still appears that a warning would be issued first. One example is a company called Sound Around was facing a $1.2m fine for selling non compliant devices after ignoring multiple warnings. They could also confiscate devices not in compliance.
For individuals, I wouldn't imagine they'd be too harsh and likely wouldn't issue any fines or penalties, but distributors could be hit pretty hard if they ignore warnings.
