I'm not a lawyer and don't even play one on TV. However, it reads to me that it applies to export and other than export elevators as defined in 800.61 1 & 2.
Finding a clear cut answer in unsurprisingly difficult as lawyers writing the rules make them so that only other lawyers can read them.
