You must have some neighbors that can't think for themself.  This is the 2nd time you have come on here with a "neighbor came to me with" question.  It is either that or what are you really doing here?  To answer your question, I don't think the neighbor can do anything as the water in the creek belongs to the people of Missouri.

As to the rest of your comments - you sure read a lot into it.  Not every landowner is on NewAgTalk.  Not every farmer is on NewAgTalk.  
 
There is a wealth of knowledge on this board.  Several things pointed out in this thread that I really hadn't thought about or considered.  
 
I guess I'm cursed in that I'm willing to help friends or a landowner out.  
 
In this situation part of me would just as soon tell the farmer 
(that I have never met
) from 40 or 50 miles away that built a pivot without having water to go pond sand.  But is that really the right thing to do?   
 
I did tell him on the phone that most people secure water rights before building a pivot!
