This is one of those things that depends a lot on what kind of guy the pivot owner is. If he's a decent guy who was mistaken originally about water access then I'd rent him access every year for a reasonable amount. If he's arrogant and expects access then he can pay through the nose for it. I say rent every year or short term lease so that you have the option to deny them or the next farmer in the future. I wouldn't do a right of way
