Need to be out there months ago (or now) getting soil samples done for nitrogen and nitrate testing. Also need someone with a stalk nitrate hand chopper to take samples NOW.
Need to have proof of N differences. Yes the pictures look bad but that could be blamed on all sorts of stuff without proof. Once the farmers have proof that in this yellow area the stalk nitrate is x and in the green area it's x plus 25 then they have something to stand on to argue about.
That's a very very good idea, and with GPS coordinates for the samples that can be matched up with yield maps. I have no idea how much weight any of those things would hold in the legal arena, but knowledge is power- and it's a very fleeting moment to get stuff like that done before a combine goes through.
