They have since found out that they are not alone. Several farmers have complained. Apparently it is tied to one operator and he has been let go. But the state wide coop doesn't seem to want to do anything about it.
No local lawyers want to help take up the issue. Do any of you know of any lawyers outside the state of Missouri that would work with a farmer on this issue?
The last thing this farming family wants to do is get into a lawsuit but this is a huge mess up on the application job.
The patterns really don't make much sense, was it some sort of variable rate apply? really looks like faulty equipment and a non observant seat warmer.
You said the operator has been let go. Sounds like they are taking steps for it not to happen in the future even if they might be scapegoating. Have you or and employee ever done something stupid or had your mind else where? Back in the old days before ravens, and Gps I have had a tank run empty and not noticed it on the pressure gauge immediately. Pulled alot of gas with a old 7520 and a rope to turn the valve on and off. Nothing is ever perfect. I usually would overlap a bit till where i knew we were good but sometimes there would still be a missed spot. Its a joke around our place that when something turns up broken or missing NOBODY will know anything about it....
No local lawyers want to get involved? That should tell you something about the legitimacy of the case....
With prices and yields on regular fields looking like they do it is going to be a case this year for revenue insurance for anybody that carries it. So the yield hit will be absorbed by your revenue insurance. Your aph will take a bit bigger hit but it is not going to be a huge gamechanger and very hard to quantify and spread out until the next time you have a loss. If you can put a number on it how are you reporting that to RMA? Rightfully you should tell them "my yields were off 20? bushel per acre because of a careless operator. And I should not get revenue coverage on that loss but my APH should also use the higher yield number" I have no idea what RMA would do with this info though.
Sometimes the best answer is to see if the coop would give you free application the next year, if you want it..., and otherwise keep your mouth closed. Stirring stuff up may just get you attention that you do not want.
Generally the only ones winning with lawyers are the lawyers, insurance companies with insurance companies, and coops with coops. |
