Tipton, KS | >distracted driving
"Lunch boy" appears to have been the causative agent...if stopped at a green light.
I have no idea how states have defined distracted driving, as in a single word, or examples given.
"There is no entry for "distracted driving" in the digitized edition of Black's Law Dictionary (2nd ed.), which is the resource powering The Law Dictionary website."
==========================
How Do You Hold a Distracted Driver Liable?
To hold a distracted driver liable, you must prove their negligence. This means establishing four key elements:
Duty of Care: Every driver has a legal duty to operate their vehicle with reasonable care to avoid harming others.
Breach of Duty: The driver failed to uphold their duty. Proving they were texting, on the phone, or otherwise distracted is direct evidence of this breach.
Causation: You must show a direct link between the driver's distraction (the breach) and the accident that caused your injuries.
Damages: You must have suffered actual harm, such as physical injuries, property damage, lost wages, or emotional distress.
